MEDICAL CARE AND INSURANCE

Participants are responsible for arranging their own coverage of medical care and emergency evacuation insurance while traveling as part of a Visionary Wild program. By registering and paying a deposit for a Visionary Wild program, you warrant that you have confirmed that you have coverage for the costs of any treatments deemed medically necessary during your travel, including emergency evacuation if required, or that you will arrange for supplementary coverage prior to the start date of the workshop or expedition for which you are enrolled. Under no circumstances will Visionary Wild, LLC or our insurers be responsible for the cost of medical treatment, emergency evacuation, or other complications due to medical emergency.

In the event that you are incapacitated and unable to make decisions regarding your own medical care during a Visionary Wild, LLC workshop or expedition, you authorize Visionary Wild, LLC staff and contractors to arrange for whatever care and treatments are deemed necessary by attending medical professionals. Visionary Wild, LLC staff will attempt to reach the emergency contact provided by you at the earliest opportunity in the case of emergency.

TRAVEL INSURANCE

Participants are encouraged to consider purchase of a travel insurance policy to cover costs related to trip cancellation, travel delays, trip interruptions, cancellations due to circumstances beyond our control, emergency evacuation, and other unforeseen complications of travel. Visionary Wild, LLC is not responsible for coverage of any such costs.

TRAVEL DOCUMENTATION AND PREPARATION

You are responsible for ensuring that you have the proper travel documents for the destination(s) to be visited. Valid passports are required for all international travel. You should check with the appropriate consulate(s) or visa agencies to determine whether visas are required, and review your public health agency’s and physician’s recommendations for health, immunizations, and safety.

You will be requested to submit certain information in advance of a Visionary Wild, LLC workshop or expedition, which may include personal details, passport information, insurance information, and other information that is necessary in order to arrange for travel and services. It is your responsibility to provide this information in the timeframe requested. If you do not provide this information when requested, we cannot guarantee that we can provide the full itinerary and services of that workshop or expedition for you.

You are also personally responsible for being in sufficiently good health and appropriate fitness level to undertake this workshop or expedition. By accepting these terms and conditions of participation, you certify that you do not knowingly have any physical limitations or other considerations of disability that would create a risk for you or other participants. We reserve the right to request a doctor’s statement of good health as deemed necessary or required.

USE OF IMAGE, LIKENESS, AND TESTIMONIALS
We reserve the right to take photographs or videos during the operation of any workshop or part thereof and to use the resulting photography in whole or in part for promotional purposes, including, but not limited to advertising and publicity in print, electronic and social media. By registering and paying a deposit for a workshop or expedition with Visionary Wild, LLC, participants agree to allow their images to be used for such purposes. If a participant prefers that their image not be used, he or she is asked to notify the tour leader(s) at the beginning of their trip.

We also reserve the right to use, in all or in part, any written reviews you may provide to us in our advertising and publicity in print, electronic, and social media.

LEAVE NO TRACE

I understand that Visionary Wild, LLC adheres to a Leave No Trace ethic with regard to its activities in nature and on public lands, and I agree to follow Leave No Trace best practices or other best practices as related to the area visited during the workshop or expedition to minimize and mitigate my impacts on places visited during Visionary Wild, LLC activities. RELEASE AND ASSUMPTION OF RISK:

By registering and paying a deposit for a program operated by Visionary Wild, LLC, I confirm that I am aware that during any photo workshop or expedition that I am voluntarily participating in under the arrangements of Visionary Wild, LLC, a District of Columbia company, and its employees, agents, contractors, and associates, certain risks and dangers exist while traveling in the United States, foreign countries, and wilderness areas in any country or territory that include the possibility of property damage, bodily injury and death. There is a possibility of accident or illness occurring without access to immediate or timely medical treatment or facilities. There is a risk of tropical or communicable diseases, food-related illnesses, the potential for personal injury and property damage or delay by forces of nature, wildlife, quarantine, political instability, terrorism, labor strikes, government restrictions or regulations change, thefts, pilferage and accidents during travel while on foot or by aircraft, train, automobile, van, bus, boat, ship or other conveyance. I understand that such risks cannot be eliminated without jeopardizing the essential qualities of this trip or tour. In consideration of, and as part payment for the right to participate in such trips, tours and/or other activities and services arranged for me by Visionary Wild, LLC, its employees, agents, contractors, and associates, I have and do hereby assume all risks, and hereby release Visionary Wild, LLC, its employees, shareholders, agents, contractors, and associates, and will hold them harmless from any and all liability, actions, causes of actions, debts, claims, and demands of every kind and nature, howsoever caused, other than resulting from the gross negligence or willful misconduct of Visionary Wild, LLC which I now have or which may arise of or in connection with any of my trips or tours and participation in any activities arranged for me by Visionary Wild, LLC, its employees, agents, contractors, and associates.

Should Visionary Wild, LLC or anyone acting on their behalf, be required to incur attorney’s fees and costs to enforce this agreement, I agree to indemnify them and hold them harmless for all such fees and costs. In the event a lawsuit is filed, I agree to do so solely in the District of Columbia, and further agree that the substantive law of the District shall apply in that action without regard to the conflict-of-law rules of that jurisdiction. The terms hereof shall serve as a release and assumption of all risk for myself, my heirs, executors and administrators, and for all members of my family.

Certain transportation services, guide services, accommodations, vehicle hire firms, outfitters, or other service providers used by Visionary Wild, LLC in the course of our workshops and expeditions require that our clients agree to standard operating terms which limit their liability. When such services not owned or affiliated with Visionary Wild, LLC are used as part of a Visionary Wild workshop or expedition travel package, I am bound by that service provider’s standard terms and conditions with respect to my legal relationship to the owners and operators of the service, their agents (Visionary Wild, LLC) and the service provider’s staff.

Because Visionary Wild does not maintain control over the personnel, equipment, or operations of these suppliers, Visionary Wild assumes no responsibility for and cannot be held liable for any personal injury, death, property damage, or other loss, accident, delay, inconvenience, irregularity of (1) wrongful, negligent, willful, or  unauthorized acts or omissions on the part of any of the suppliers, or other employees or agents, (2) any defect in or failure of any vehicle, equipment, instrument owned, operated, or otherwise by any of these suppliers, or (3) any wrongdoing, willful, or negligent acto or omissions on any part of any other patry not under the supervision or control of Visionary Wild, LLC.

I have read and agree to the terms and provisions of the Visionary Wild Registrant Information form, as stated in the Visionary Wild, LLC catalog/website/brochure pertaining to my trip, especially noting the policy on cancellations, refunds, and limitations on responsibility.

If any part, article, paragraph, sentence or clause of this Agreement is not enforceable, the affected provision shall be curtailed and limited only to the extent necessary to bring it within the requirements of the law, and the remainder of the Agreement shall continue in full force and effect.

By signing my agreement to this document, I acknowledge that if anyone is hurt or property is damaged during my participation in this activity, I may be found by a court of law to have waived my right to maintain a lawsuit against Visionary Wild, LLC, its employees, shareholders, agents, contractors, and associates, on the basis of any and all claims from which I have released them.
